Terms of Service

1. Acceptance of Terms

By accessing or using Juicy CRM or the Juicy Tracker app ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. These terms are governed by the laws of South Africa.

2. Description of Service

Juicy provides two connected products:

• Juicy CRM: A practice management platform for registered nutrition professionals, including client management, meal planning, invoicing, and analytics tools.
• Juicy Tracker: A food and nutrition tracking app for clients of nutritionists using Juicy CRM, or for individuals tracking independently.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• One person or entity may not maintain more than one free account.

4. Nutritionist Responsibilities

If you use Juicy CRM as a nutrition professional, you agree that:

• You are a qualified and registered nutrition or dietetics professional, or otherwise authorised to provide nutritional guidance in your jurisdiction.
• You are solely responsible for the accuracy of nutritional advice, meal plans, and health recommendations you provide to clients.
• You will obtain appropriate consent from clients before collecting and processing their personal data, in compliance with POPIA.
• You will not use the Platform to store data for purposes unrelated to nutrition practice management.
• You are responsible for securing access to your account and your clients' data.

6. Subscription & Billing

• Juicy CRM is available on a paid subscription basis after a 14-day free trial.
• Subscriptions are billed monthly. Prices are displayed in South African Rand (ZAR) and are inclusive of applicable taxes.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Juicy Tracker is free for end users / clients.
• Partner Discount Tiers. Eligible nutritionists receive discounted subscription rates based on the number of active clients linked to their practice: 0% (up to 10 clients), 20% (11–30 clients), 35% (31–60 clients), and 50% (61+ clients). The first payment after the 14-day free trial is charged at the full list price. Discounted rates are applied from the first full billing cycle after the trial period and are reassessed monthly based on your active client count at the time of reassessment. Discounts are applied to the recurring subscription amount only and do not apply retroactively to payments already made.

7. Acceptable Use

You may not use the Platform to:

• Violate any applicable laws or regulations.
• Upload or transmit harmful, offensive, or illegal content.
• Attempt to gain unauthorised access to any part of the Platform or another user's data.
• Reverse engineer, copy, or resell any part of the Platform.
• Use the Platform in a way that could damage, disable, or impair its operation.

8. Intellectual Property

All content, features, and functionality of the Platform — including logos, design, code, and text — are the exclusive property of Juicy and are protected by applicable intellectual property laws. You retain ownership of any data you upload to the Platform.

9. Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by South African law, Juicy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform. Our total liability to you for any claims arising from the use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Platform ceases immediately. You may request an export of your data within 30 days of termination.

12. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa. We encourage you to contact us first to resolve any issues informally at insights@juicies.site.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
